ThetaBreathwork LLC ā€“ Terms of Use

These Terms of Use ("Terms") constitute a legally binding agreement between ThetaBreathwork LLC ("Company," "we," "our," or "us") and you ("User," "you," or "your") governing your use of the ThetaBreath mobile application (the ā€œAppā€), including all related features, services, and content, including the ThetaBreathworkĀ® Membership.

By accessing or using the App, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, you must not use the App.

1. Acknowledgment

These Terms are concluded between you and ThetaBreathwork LLC, not Apple Inc. ("Apple"). Apple is not responsible for the App and its content.

Apple has no obligation to provide any maintenance or support services related to the App.

2. License Grant

ThetaBreathwork LLC grants you a limited, non-exclusive, non-transferable, revocable license to use the ThetaBreath App for personal, non-commercial purposes on any Apple-branded devices that you own or control, in accordance with Appleā€™s App Store Terms of Service.

You may not:

  • Distribute, rent, lease, lend, sell, or sublicense the App.
  • Modify, reverse-engineer, decompile, or attempt to extract the App's source code.
  • Use the App for any illegal or unauthorized purpose.

ThetaBreathwork LLC reserves all rights not expressly granted to you.

3. Appleā€™s Role in Purchases & Subscriptions

Purchases and subscriptions for ThetaBreathworkĀ® Membership are processed exclusively through Appleā€™s In-App Purchase system.

  • Billing & Renewals: Apple handles billing, renewals, and cancellations.
  • Refund Policy: All refund requests must be directed to Apple Support, as we do not manage or process refunds for in-app purchases. Appleā€™s refund policy applies.

Apple is not responsible for providing any refund or compensation for purchases made in the App.

4. Subscription Terms & Cancellation

Your ThetaBreathworkĀ® Membership subscription will automatically renew unless canceled at least 24 hours before the renewal date. You can manage or cancel your subscription by going to Settings > Apple ID > Subscriptions on your Apple device.

ThetaBreathwork LLC does not have the ability to cancel your subscription on your behalf.

5. Maintenance & Support

ThetaBreathwork LLC, not Apple, is responsible for:

  • Providing technical support for the App.
  • Maintaining updates to ensure compatibility and security.
  • Resolving any issues or bugs.

6. Disclaimer of Warranty

The App is provided ā€œas isā€ and ā€œas availableā€, without warranties of any kind, either express or implied.

Neither ThetaBreathwork LLC nor Apple guarantees that:

  • The App will function without errors or interruptions.
  • The results obtained from the App will be accurate or reliable.
  • Any defects will be corrected.

7. Product Claims

ThetaBreathwork LLC, not Apple, is responsible for handling any claims related to:

  • Product liability.
  • Non-compliance with legal or regulatory requirements.
  • Consumer protection or privacy issues.

8. Intellectual Property Rights

All trademarks, logos, and content in the ThetaBreath App and ThetaBreathworkĀ® Membership are the property of ThetaBreathwork LLC.

Apple is not responsible for any intellectual property claims related to the App.

9. Legal Compliance

By using the App, you represent that:

  • You are not located in a country subject to a U.S. government embargo or designated as a "terrorist-supporting" country.
  • You are not listed on any U.S. government prohibited or restricted parties list.

10. Third-Party Beneficiary

You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of the Terms, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflicts of law principles.
